Terms of service

These terms are an agreement between you and Quinn Care Private Limited ("Quinn", "we", "us") for your use of LastCut, at app.lastcut.video and on WhatsApp (the "Service"). By using it you agree to them; if you don't, please don't use it. Our privacy policy says how we handle personal data.

1. Accounts

You must be at least 18 and able to make this agreement. LastCut is invite-only for now. Keep your sign-in to yourself; you're responsible for what's done in your account and organization.

2. The Service

LastCut turns ideas and scripts into short videos presented in a person's own likeness and voice, made with AI, and can post them to the Instagram and YouTube accounts you connect. We may change, add or remove features. AI makes mistakes: check every video, its words and its facts before you post it.

3. Consent of the person in the videos

You may make videos only of yourself, or of someone who has given you their clear consent to have their likeness and voice used this way, and you must be able to show that consent if asked. You may not use the Service to make sexual or intimate imagery of anyone, to impersonate a real person or organization, or to present anyone as saying or doing something they didn't agree to.

4. Your content and the videos

You keep the rights you have in what you give us (photos, recordings, scripts, files) and, as between you and us, in the videos made for you. You give us the licence we need to store and process them to provide the Service to you, including sending them to the providers that make the videos. You promise you have the rights and consents needed for everything you upload and for the videos you post, including any music, brands or people in them.

When you connect Instagram or YouTube, you allow us to post the videos you ask us to and to read your posts and their numbers, as the privacy policy describes. Those platforms' own terms apply to what's posted there, and you're responsible for it. You can disconnect at any time.

7. Credits and payment

Videos and some tools use credits, bought in advance as shown at the time of purchase. We may change prices for the future with reasonable notice. Credits paid to Quinn are non-refundable, unless we say otherwise or the law requires it.

8. Third-party services

The Service relies on other providers (for hosting, AI, messaging and payments) and works with platforms you connect, such as Instagram and YouTube. We aren't responsible for their services, and their availability may affect ours.

9. Disclaimers

THE SERVICE AND ALL VIDEOS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ITS OUTPUTS WILL BE ACCURATE OR FIT FOR ANY PARTICULAR USE.

10. Limitation of liability

TO THE MAXIMUM EXTENT THE LAW ALLOWS, QUINN AND ITS AFFILIATES WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. QUINN'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WON'T EXCEED THE GREATER OF (A) WHAT YOU PAID QUINN FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR 10,000.

11. Indemnity

You'll indemnify and hold harmless Quinn and its affiliates, officers and employees against any claims, losses and reasonable costs (including legal fees) arising from your content, the videos you make or post, your use of the Service, or your breach of these terms or of anyone's rights.

12. Ending the agreement

You can stop using LastCut at any time, and ask us to delete your account by writing to support@quinn.live. We may suspend or end your access if you break these terms, for legal or security reasons, or if we stop offering the Service. What by its nature should outlast the agreement (licences already given, disclaimers, limits of liability, indemnity, governing law) does.

13. Changes

We may update these terms. We'll post the new version here with a new date and, for an important change, tell you in LastCut or by email. Using LastCut after a change means you accept it.

14. Governing law and disputes

These terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to applicable law, the courts at Quinn's registered office in India have exclusive jurisdiction over any dispute about them or the Service.
